Suggestions on the Protection of the right to privacy on the Internet in China
Feasibility Analysis of Adopting Self-regulation Mechanism,
Legislation and Real-name System in China
According to the above-mentioned protection measures, this part
will focus on the analysis on their feasibility if being adopted in
China.
With respect to Self-regulation Mechanism in the United States, it
is chiefly based on the American culture – advocacy for
self-discipline and the right to privacy– and the mature legal and
social environment on the protection of the right to privacy. Since it
allows flexibility to the development of network technology, it also
leaves loopholes on the execution. Practically speaking, China's legal
system is still far from perfect, not to mention the self-regulation
of social organizations. If Self-regulation Mechanism is adopted as
the major measure in China, it will miss the goal to supervise and
protect netizen's right to privacy on the Internet owing to its weak
compulsiveness.
Speaking of Legislation in the European Union, it is more suitable
to China's own condition. Legislation can work as a warning to
regulate behaviors of individual and institution so as to protect
people's right to privacy on the Internet. Some defects as it has,
legislation remains the most useful and suitable measure to fight
against the infringement on the right to privacy on the Internet.
Meanwhile, it shall meet two basic requirements. For one thing, the
legislation shall offer full protection to the right to Internet
privacy. For another, it must not obstruct the normal circulation of
information and has to take into consideration the necessary social
governance and supervision.
